Liability Waiver

By purchasing your Wilder Waters Gathering pass you are agreeing to this release of liability:

I am aware that the Wilder Waters Gathering activities of any kind, held at any location, entail the risks of injury or death. I understand that the description of these risks is not complete and that other unknown or unanticipated risks may result in injury or death. I agree to assume ALL responsibility for ALL the risks including staff or employee error, negligence of Wilder Waters Gathering and those risks not specifically identified. My participation in Wilder Waters Gathering activities is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of the risks. I am capable of participating and ACCEPT ALL RESPONSIBILITY FOR MYSELF, including my minor children, for bodily injury, death, loss of personal property, and expenses thereof. I have read, understood and accepted the terms and conditions stated herein and acknowledge this agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives, estates, and for all members of my family including minor dependents and all those accompanying me. I acknowledge I am not relying on any oral, written or visual representations or statements made by Wilder Waters Gathering, including those made in its brochures, on its web site or other promotional materials to induce me to participate in any Wilder Waters Gathering program.

Indemnity
I agree to indemnify and hold Wilder Waters Gathering, and its subsidiaries, affiliates, directors, officers, agents, vendors, staff, instructors or other partners and employees harmless from any claim or demand, including attorney fees, made by any third party due to or arising out of any material or information posted, provided, transmitted or otherwise made available to me by Wilder Waters Gathering or through Wilder Waters Gathering services, or by my violation of the rights of another.

Disclaimers and Limitation of Liability
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM DAWNLAND GATHERING OR THROUGH OR FROM ITS SERVICES SHALL CREATE ANY WARRANTY OR GUARANTEE. IN NO EVENT SHALL WILDER WATERS GATHERING OR ITS OWNER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES.
Some jurisdictions do not allow disclaimer, exclusion or limitation of incidental or consequential damages, so the foregoing disclaimer, exclusion and limitation may not apply to you. If there is any dispute about or involving Wilder Waters Gathering, you agree the dispute shall be governed by the laws of the state Maine, USA, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the state Maine, City of Alburn. You also agree and hereby submit to the exclusive personal jurisdiction and venue of the federal district and state courts of Maine with respect to such matters.
